DATA PRIVACY POLICY - LGPD

Felipe Amaral Advocacia e Consultoria works in the provision of legal services and is also concerned with the protection of data and personal information that are shared by its clients and all other components of our service chain.

 

Therefore, it is necessary to have a policy that defines how data is protected in the collection, registration, storage, use, sharing, enrichment and elimination processes, in accordance with  Law nº 13.709/2018 (General Law Protection)  e in line with our mission and values.

The legislation regarding privacy and data protection has many definitions of its own, so we present some definitions that will help you understand our policy.

Personal Data: Brazilian law defines “personal data” as all that refers to an identified or identifiable natural person. In practice, the expression includes all data that allows identifying a person, such as: name, CPF, identification number, photograph, etc. In addition, personal data may or may not be sensitive.

User: natural person who interacts with the Firm in situations where he makes his personal data available. Examples: people browsing your website, employees, third parties or service providers, event subscribers, etc.

Treatment: any operation carried out with personal data, such as those relating to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication , transfer, diffusion or extraction;

Consent: free, informed and unequivocal expression by which the holder agrees to the processing of his/her personal data for a specific purpose;

What data do we collect and process?

All data provided by the user will be processed, and we collect only the information necessary for better efficiency of the services provided and interaction with our page.

Customers, visitors to our page and physical structure who provide their information for registration and receipt of information, our employees and service providers, are the holders of the data provided.

How do we collect?

Collections take place when we:

  • Forms of legal assistance carried out in our physical unit or through virtual means through the SurveyHeart website or Google Forms;

  • Provision of data through the partners;

  • Sending and entering data via the website to receive newsletters and other information;

  • Event registration.

Use of Personal Data  

Felipe Amaral Advocacia e Consultoria becomes responsible for the treatment of the personal data of its users.

The personal data of its users collected, including those directly or indirectly related to legal activity, will be processed for the purpose of providing legal, educational, informative services and for the dissemination and confirmation of events.

The office may process the personal data collected for the purposes provided for in the informed consent when collected on the website and in cases where there is a legal authorization basis as provided for in the General Data Protection Law, for the regular exercise of rights in judicial, administrative or legal proceedings. arbitration, the latter under the terms of Law No. 9,307, of September 23, 1996 (Arbitration Law), as well as for satisfaction surveys to improve our services, among others.

For the avoidance of doubt, we inform you specifically in which situations we will use your data:

Provision of legal, judicial and extrajudicial services:

  • Compliance with legal obligations that require the provision of data, for example, issuance of judicial guides;
    – Execution of the contract, or preliminary procedures related to the client's contract (item V of article 7 of Law No. 13.709/18); 

  • For internal control and maintenance of the service provision contract;
    – Legal or regulatory obligation (item II of article 7 of Law No. 13,709/18); 

  • Improvement of internal processes with the measurement of customer evaluation;
    – Legitimate interest in commercial support and promotion (item IX of article 7 of Law No. 13,709/18);

  • Provision of information related to the service provided, courses offered, as well as institutional communications;
    – Legitimate interest in commercial support and promotion (item IX of article 7 of Law No. 13,709/18);

  • Submission of procedural information using an internal control system;
    – Execution of the contract, or preliminary procedures related to the client's contract (item V of article 7 of Law No. 13,709/18);

  • Representation of Lara Martins lawyers in any type of administrative and/or judicial claim.
    – Defense and use in legal proceedings (item VI of article 7 of Law No. 13,709/18);

In cases of treatment based on legitimate interest, the user can always choose to delete data from our database.

Sharing Personal Data

There are information that will need to be shared, but in these cases the user will always be informed in advance for authorization in cases where there is no legal basis for such.

I am the data subject, what are my rights?

Article 18 of the General Data Protection Law determines that:

The holder of personal data has the right to obtain from the controller, in relation to the data of the holder processed by him, at any time and upon request:

  • Confirmation as to the existence of processing of personal data and obtaining, at any time, access to your data;

  • Correction of incomplete, inaccurate or outdated data;

  • Request the anonymization, blocking or elimination of unnecessary, excessive or treated data in violation of the General Data Protection Law;

  • Information regarding data sharing;

  • Deletion of your personal data processed with the consent of the holder, in this case the emails for receiving electronic messages;

  • Data portability, to another service provider, upon your request;

  • Revocation of consent, pursuant to § 5 of art. 8 of the LGPD.

Cookies

We need to inform you, that we use Cookies, but what is it anyway?

Cookies are plain text files, sent by the website to the browser (Chrome, Mozilla, Internet Explorer and others) the first time you visit it. On your next access, the browser sends the data back to the website so that your information is automatically configured. Preservation of Personal Data

The data are kept for the period strictly necessary for each of the purposes described above and/or in accordance with current legal deadlines. In case of pending litigation, the data may be kept until the decision becomes final.

As long as your data remains with us, we will keep in operation all the technical means at our disposal to prevent the loss, misuse, alteration, unauthorized access and misappropriation of your users' personal data.

If necessary, remember that in cases of internet browsing, it is not possible to completely eliminate the risk of unauthorized access and use, and therefore the user must also program adequate security measures for browsing the website.

Complaints and Doubts
